Mr. Burtness:
“Let me say at the outset that your draft report is the best expert witness report that I have ever seen in my more than 57 years of practicing commercial litigation and seeing hundreds of such reports.
Thank you.”

Tom Burtness Speaking to the Illuminating Engineering Society (IES) Annual Street and Area Lighting Conference (SALC) in Austin Texas in September 2017 on How to Serve as a Lighting Expert Witness. https://www.ies.org/events/street-area-lighting-conference/
“An issue of adequacy of lighting on a piece of industrial equipment presented itself in the middle of a wrongful death case in which I was lead counsel. We retained Tom and he quickly educated us on the issue and prepared a very thorough federal court expert report which the defense experts found difficult to impossible to rebut. What we first believed to be an ancillary issue became our prime theory of defective design. He was later deposed and he did a wonderful job educating opposing counsel and it was clear he would likewise educate and inform a jury if called upon to do so. The case was favorably resolved for our client.”

Tom,
“We wanted to provide a sincere thank you for all of your efforts on this matter that assisted us in reaching this result. We appreciate your work and the diligence that you provided and showcased in all of your expert opinions. You were also a great resource for us as we undertook the process of trying to evaluate and bring to light the fraud an opposing expert is committing on courts around this country. It was a pleasure to meet you, and I, for one, learned a number of new things in speaking with you, reviewing your reports, and listening to your testimony. Thanks again for your work on this matter. I speak for the whole team when I say your contributions were greatly appreciated, and we look forward to working with you again in the future!”

Dear Tom,
“I want to thank you for all the help in this case. While the terms of the settlement are confidential, we were able to obtain a significant settlement against the lighting defendants because of your help. While your ultimate opinions were important, I appreciated your guidance and suggestions on discovery as the case progressed. You were always accessible throughout the case. Please feel free to use me as a reference in the future. I look forward to working with you again in the future.”

“I retained Tom Burtness for a very difficult and technical case involving lighting and lighting engineering issues. Tom was instrumental in locating the pertinent standards and publications that helped me craft my case strategy, and in preparing a detailed report that simplified the issues. Tom has a deep and thorough knowledge of lighting and technical issues related to municipal and highway lighting standards and does very well in deposition. Tom also helped me dissect the opposing experts’ theories and helped me develop lines of questioning for deposition. I can highly recommend Tom Burtness.”

Tom,
“The Court heard our Motion for Summary Judgement this morning. In a well-considered decision, all of plaintiffs’ claims were dismissed on the merits. Your inspection and reports played an important role against the unfair speculation of plaintiffs’ experts. It was a distinct pleasure working with you. Thanks, PJ”

Tom,
“Thank you for your input on our recent electrical worker shock case. Both your report and trial testimony were very professional and helped carry the day. The Jury awarded 4.2 million reduced by 35% comparative fault for a net of $2.75M. You’re testimony helped get that result. Thanks for your effort and professionalism.”
